A DUI driver with 5 prior convictions was sentenced to 25 years in prison
for felony DUI after causing a
car accident that caused the death of a young man, Jonathon Lee Humphrey. The DUI driver,
46-year-old David Onley, was reported by police authorities to have been
driving his truck 85 miles per hour in a 35 miles per hour zone. His blood
alcohol concentration was reported at being at a level of .20, which is
over twice the legal limit allowed when operating a vehicle.
DUI drivers are responsible for a high percentage of fatal car accidents and innocent
lives are lost in seconds. Drivers that operate a vehicle while impaired
often speed, swerve from lane to lane, drive the wrong way on highways
or roads and are extremely unpredictable. When another person dies due to
negligent driving behavior, the close family has the right to file a civil claim against the driver
and pursue compensation in a wrongful death case. In a case in which the
victim survives, compensation can be sought for both economic and non-economic damages.
These damages include all actual costs that are the result of the injuries
sustained, such as medical bills, lost employment income and any future
predicted financial losses. The non-economic damages are those such as
pain and suffering. In very serious injuries, such as
blunt force trauma,
spinal cord injuries, or other types of damages that permanently alter the future of the victim,
the compensation sought will be very high value, as there is often the
need of a lifetime of medical care and treatment.
The quality and experience of the law firm representing the victim is likely
to be a significant factor in the final settlement or verdict awarding
damages in civil court. In cases in which it is fully established that
the harm done to the victim was the result of the defendant's "willful,
wanton or reckless conduct," it could be possible to pursue punitive damages.
